By accessing the Site, scheduling service, or purchasing any products or services from Alabama Cooling and Heating (collectively, the 'Services'), you agree to be bound by these Terms of Use (the 'Terms'). If you do not agree, do not use the Site or Services.

You must be at least 18 years old and legally capable of entering into binding agreements to use our Services.

We provide heating, ventilation, and air conditioning (HVAC) services, including diagnostics, maintenance, repairs, installations, indoor air quality solutions, ductwork, and emergency service. Details, pricing, and conditions will be outlined in your work order, estimate, or service agreement.

Estimates are valid for 30 days unless otherwise stated. Prices may vary due to site conditions, equipment availability, or changes requested by you. Any change orders must be authorized and may affect price and timelines. Discounts apply only as expressly stated.

Customer cancellations require 24-hour notice; same-day cancellations may incur a fee or trip charge. We may reschedule due to safety concerns, emergencies, or circumstances beyond our control.

Payment is due upon completion unless otherwise agreed in writing. Deposits may be required for equipment orders. We accept cash, check, major credit cards, and ACH. Past-due balances may incur late fees and/or interest to the maximum extent permitted by Alabama law. Returned checks/ACH may incur an NSF fee. You are responsible for reasonable collection costs and attorney’s fees, as allowed by law.

Alabama Cooling and Heating reserves all rights under Alabama law to file and enforce a mechanic’s lien or materialman’s lien against the property where Services were performed for any unpaid labor, materials, or equipment provided. Failure to pay in full may result in a lien being recorded against your property, and you will be responsible for associated costs, including filing fees, interest, and legal expenses incurred in enforcing lien rights.

If you enroll in an Annual Maintenance Plan ('Plan'), the following terms apply: Coverage includes scheduled inspections/tune-ups and priority service as outlined in your enrollment confirmation. Term & Renewal: Valid for 12 months from enrollment; auto-renews unless canceled in writing at least 30 days before renewal. Payment: Fees due upfront or via approved monthly auto-pay. Nonpayment may suspend or cancel benefits. Exclusions: Repairs, parts, emergency services, and non-routine work are not included unless expressly stated. Transferability: Transferable to a new homeowner at the same property with written notice. Cancellation: You may cancel anytime; prorated refunds for unused months may be provided at our discretion and may be subject to an administrative fee. Priority Service: Members receive priority scheduling during peak seasons, subject to availability.

Some purchases may be eligible for third-party financing offered by independent finance companies or lenders ('Financing Providers'). Financing is subject to credit approval and governed by the Financing Provider’s separate terms and disclosures. Alabama Cooling and Heating is not a lender or broker and is not responsible for the Financing Provider’s actions, decisions, servicing, or collections. You authorize us to share necessary order information with the Financing Provider solely to facilitate your financing application and disbursement. Payment to us may be made by the Financing Provider on your behalf. Your obligation to repay the Financing Provider remains even if we have been paid. Promotional financing offers are administered by the Financing Provider. Disputes related to financing must be raised directly with the Financing Provider.

Workmanship Warranty: [Insert period, e.g., 1 year] from completion, unless otherwise stated in writing. Manufacturer warranties apply as provided by the manufacturer. Exclusions include normal wear, misuse, neglect, unauthorized alterations, acts of God, and issues caused by site conditions beyond our control.

These Terms and any dispute or claim relating to the Site or Services are governed by the laws of the State of Alabama. Exclusive venue and jurisdiction for any claim, action, or proceeding shall lie in the state courts located in Talladega County, Alabama, or the U.S. District Court for the Northern District of Alabama.

We may update these Terms from time to time. Changes become effective upon posting on the Site with the revised Effective Date. Continued use of the Site or Services after changes are posted constitutes your acceptance.
